Participation Agreement

Welcome to Myna Trips Pvt. Ltd., hereinafter referred to as “Myna Trips.” 

Adventure begins where the predictable ends. For an activity to truly be an adventure, you must embrace an element of uncertainty, which inherently carries risks. Traveling through mountainous regions and remote destinations, often paired with high-altitude treks, climbs, helicopter tours, and cultural explorations, comes with inherent hazards. These risks can include challenging terrain, unpredictable weather, and physical exertion, and in rare cases, may result in injury or even death. Anyone considering participation in our trips must carefully assess these risks and accept responsibility for their involvement.

Our journeys take you to some of the most breathtaking and culturally rich destinations in Nepal, Tibet, and Bhutan. These regions are not only visually stunning but often remote and underdeveloped, with limited infrastructure. This means that in the event of an injury or health issue, evacuation can be delayed, leading to outcomes that might be more severe than if the incident occurred closer to home.

At Myna Trips, we strive to create experiences that ignite your sense of wonder and inspire you to explore beyond the ordinary. From the towering peaks of the Himalayas to the vibrant cultures of these unique regions, our trips promise unforgettable moments shared with like-minded adventurers.

However, to embrace these rewards, you should also embrace the inherent risks and challenges of adventure travel.

1. Booking and Payment Policies

1.1 Reservation Process

To confirm your booking, you must submit a completed booking form and a non-refundable deposit:

Nepal Trips: 30% of the total trip cost.

Bhutan and Tibet Trips: 50% of the total trip cost.

1.2 Final Payment

Our trip prices are listed in USD. For payments made in local currencies, the exchange rate set by Nepal’s Central Bank for USD on the date of conversion will be applied.

For Nepal Trips, the remaining balance must be settled at the pre-trip meeting upon arrival in Nepal or via credit card or bank transfer before arrival.

For Bhutan and Tibet Trips, the remaining balance must be settled in USD by credit card or bank transfer at least 20 days before departure.

1.3 Last-Minute Bookings

Nepal Trips: Accepted up to 10 days before departure. Full payment is required and is non-refundable.

Bhutan and Tibet Trips: Accepted up to 20 days before departure. Full payment is required and is non-refundable.

1.4 Payment Methods

WeTravel Platform: Supports multiple currencies; processing fees apply (Visa/Mastercard: ~3%, American Express: ~4%).

Direct Wire Transfer: Clients bear transaction fees. Bank details are provided upon request.

Credit Card Payments: A 4% processing fee applies.

Cash Payments: Accepted in USD, EUR, GBP, AUD, and CAD (clean $50 and $100 bills only; pre-2009 USD bills not accepted).

2. Cancellation and Refund Policy

2.1 Cancellations by the Client

Nepal Trips:

20+ days before departure: 30% cancellation fee.

Less than 20 days before departure: No refund.

Bhutan and Tibet Trips:

30+ days before departure: 50% cancellation fee.

Less than 30 days before departure: No refund.

Note: Deposits are non-refundable. Documentation for insurance claims will be provided upon request. Agents and representatives, other than a Director of Myna Trips are not entitled to promise refunds for whatever reason, and Myna Trips will not be bound by any such promises.

2.2 Rescheduling

Nepal Trips: Requests must be made at least 20 days before departure. A USD 200 per person fee applies.

Bhutan and Tibet Trips: Requests must be made at least 30 days before departure. A USD 500 per person fee applies.

3. Travel Insurance

Comprehensive travel insurance is mandatory for all clients and must cover:

  • High-altitude trekking.
  • Emergency evacuation (including helicopter rescue).
  • Medical expenses and trip cancellation.

4. Health and Fitness Requirements

Clients must be in good health and disclose any pre-existing medical conditions during booking.

Participation may be denied if a health condition poses a safety risk.

5. Responsibilities and Risks

5.1 Assumption of Risk

Adventure travel involves inherent risks, such as altitude sickness, harsh weather, and rugged terrain. By booking, you acknowledge and accept these risks.

5.2 Liability

Myna Trips is not responsible for injuries, illnesses, or losses unless caused by proven negligence.

5.3 Force Majeure

We are not liable for disruptions caused by events beyond our control, including natural disasters, political unrest, or pandemics.

6. Itinerary Changes

Itineraries may change due to weather, trail conditions, or unforeseen circumstances. Any adjustments prioritize client safety and interests.

7. Passport, Visa, and Permits

A passport valid for six months beyond your return date is required. For Nepal Travel, visas can be obtained upon arrival at Kathmandu Airport or at Nepalese consulates. We handle permits and their costs are included in trip prices. Documentation (passport scan, photograph, and insurance) is required at booking.

8. Helicopter Tours and Emergency Evacuations

Helicopter tours and rescue services depend on weather and availability.

Costs for emergency evacuations are borne by the client or covered by their insurance.

9. Behavior and Conduct

Clients must act responsibly and respect local customs and laws. You will visit places and meet people whose ways of living, beliefs, religions, and political inclinations, are different from yours. Please embrace the differences. Humility and compassion for the people on the other side of things go a long way. Mutual respect is a currency that works everywhere in the world.

Please consult with the travel guide assigned to you on local practices and etiquette. Disruptive, obscene, or unsafe behavior may result in removal from the trip without refund.

10. Complaints and Dispute Resolution

Complaints during the trip should be reported to the trip leader immediately. If you have a grievance related to your travel guide or the way the trip was operated, please submit written complaints within 30 days after the trip concludes.

11. Governing Law

Myna Trips is a licensed and registered entity based in Kathmandu, Nepal. These terms and conditions are governed by the laws of Nepal. Any claims or disputes arising under these terms will be exclusively resolved within the jurisdiction of Nepalese courts, specifically the Kathmandu District Court, Patan High Court, or the Supreme Court in Kathmandu. Both parties agree that no legal proceedings shall be initiated or pursued outside Nepal, and the aforementioned courts will serve as the sole venue for addressing all related matters.

Additional Information

Domestic Flight Delays

Flights to mountain regions are subject to weather delays. Clients should plan for extra days. Helicopter options may be available at an additional cost (~USD 550 per person, one-way).

Unforeseen Circumstances Disclaimer

We are not responsible for costs arising from political changes, weather conditions, health issues, or natural disasters. Additional expenses are the client’s responsibility.
